Kauffman Supports Right to Self-Defense

State Rep. Rob Kauffman (R-Cumberland/Franklin) today once again voted in favor of legislation providing an individual the right to use force, even deadly force, in defense of one’s self and others within one’s home, occupied vehicle, or anywhere the individual has the right to be.


“Our constitution grants us the right to bear arms and this legislation further guarantees that right,” said Kauffman. “For far too long, the law has been written in a way that protects the rights of the criminal more so than those of law-abiding citizens. No one should ever be placed in the position of wondering whether they have the legal right to protect themselves against an intruder when they believe they are in imminent danger, and the Castle Doctrine clarifies that situation.”


Under current law, a law-abiding citizen is required to retreat before using deadly force against an intruder who poses a threat to the life and safety of themselves and/or their family.


Kauffman noted there are exemptions to House Bill 40, such as if the person entering the home is another resident, a law enforcement officer or a parent, grandparent or other guardian removing a child from the home or occupied vehicle.


House Bill 40 passed the House and Senate last session only to be vetoed by Gov. Ed Rendell. Kauffman said he is hopeful that this time the legislation will make it through the entire legislative process and become law.


The Castle Doctrine passed the House with widespread bipartisan support.
