Kauffman Legislation Signed by Governor
HARRISBURG - Last week, legislation sponsored by State Rep. Rob Kauffman (R-Franklin) to help pharmacy customers in border communities, was signed into law by the governor. The legislation, now Act 43 of 2015, extends protections to Pennsylvania residents who use out-of-state pharmacies that regularly do business with customers from the Commonwealth.

Act 43 provides oversight to out-of-state pharmacies by requiring them to register with the Pennsylvania State Board of Pharmacy every two years and report to the board within 30 days any disciplinary action taken by the licensing agency in the pharmacy’s home state. It also prohibits nonresident pharmacies from advertising their services in Pennsylvania unless they are registered.

“Many residents living along Pennsylvania’s borders may travel out of state to fill their prescriptions. Without those pharmacies being registered with the state Board of Pharmacy, Pennsylvania has been unable to respond to consumer complaints or apply the oversight to ensure they meet the high standards that residents of the Commonwealth expect,” said Kauffman. “My legislation ensures this high quality of service for Pennsylvania’s consumers, by requiring out-of-state pharmacies to register with the state Board of Pharmacy, if they wish to conduct business with our residents.”

With Kauffman’s legislation, Pennsylvania will join 48 other states in requiring the registration of out-of-state pharmacies. Act 43 of 2015 takes effect in 60 days.
