Kauffman Supports Right to Protect Self and Family
State Rep. Rob Kauffman (R-Cumberland/Franklin) today continued his support of upholding an individual’s Second Amendment rights by voting in favor of legislation providing for the use of deadly force in defense of self and others within an individual’s home or occupied vehicle.
“No person should have to be concerned about possible legal ramifications when protecting oneself or family from an intruder entering their home or occupied vehicle – even when that protection requires the use of deadly force,” said Kauffman. “Our constitution guarantees us with the right to bear arms and this legislation further guarantees that right when protecting one’s home and family.”
There are exceptions to the legislation, such as if the person entering the home is another resident, a law enforcement officer or a parent, grandparent or other guardian removing a child from the home or occupied vehicle.
Kauffman noted that there is also a civil immunity safeguard built into the legislation that would prevent a law-abiding citizen from being forced into a frivolous lawsuit due to self-defense.
“Keep in mind that this legislation is not encouraging people to use deadly force unnecessarily,” said Kauffman. “It is simply protecting their right to do so when the circumstances warrant such use. House Bill 40 is one more measure that protects the rights of law-abiding citizens, instead of protecting the rights of criminals.”
House Bill 40 passed the House by a vote of 159-38.
